These Terms and Conditions ("Terms") apply to the relationships regarding the Canon Photokina 2016 Competition (“Competition”) as described below between: (a) Canon Europa N.V. registered in Amsterdam under registration number 33166721 having a place of business at Bovenkerkerweg 59, 1185 XB Amstelveen, The Netherlands, and other Canon group companies (collectively, “Canon”) and you, the entrant of the Competition (“You”). By submitting Your image(s) to participate in this Competition, You agree that You have read, understood and accepted all these Terms.
1. COMPETITION ENTRY
1.1 This Competition is open to all residents of United Kingdom & Ireland, Germany, France, Spain, The Netherlands, Portugal, Austria, Belgium, Switzerland, Sweden, Denmark, Finland, Norway, Poland, Hungary, Slovakia, Slovenia, Croatia, Romania, Turkey, Czech and Russia, aged 18 years or over. Employees of Canon and their immediate families, the agencies or anyone professionally connected with this Competition are not eligible to participate.
1.2 This Competition consists of one competition with a dedicated theme and designated period (“The Competition”). The theme of The Competition is story telling through photography, the upload period (“Upload Period”) is as follows: Open Date: 09:00 05/09/16; Close Date (“Close Date”): 23:59 11/09/16
1.3 You must “like” the Canon Photokina Page on Facebook and /or follow @CanonPhotokina on Twitter to enter into this Competition. You can choose to participate numerous times by uploading up to five (5) images relating to the dedicated theme to either “Canon Photokina Facebook Page” located at facebook.com/CanonatPhotokina (as a photo post on the timeline using the hashtag #PursuitoftheShot) or to Twitter by posting a photo tweet directed at @CanonPhotokina and using #PursuitoftheShot in the body of the tweet (links to photos hosted outside Twitter will not be counted as entries). All entries must be uploaded within the designated Uploading Period; otherwise, it will not be accepted or valid.
1.4 All images uploaded in connection with this Competition will be accessible for other entrants to view and all valid entries will be displayed at http://facebook.com/CanonatPhotokina and http://twitter.com/CanonPhotokina, as well as on digital screens at Canon events. By uploading Your image(s), You explicitly agree to such use.
1.5 The Competition is in no way sponsored, endorsed or administered by, or associated with Facebook or Twitter. A condition of entry to this Competition is that You grant a complete release to Facebook and Twitter from any claims that they now have or may have in the future which relate to or are incidental to this Competition.
1.6 Canon cannot be held responsible for any web entries not received due to technical problems.
1.7 Canon reserves the right to disqualify any individual which, at its sole discretion, it believes has tampered with the entry process or who has breached any rules of this Competition.
2. PRIZE SELECTION
2.1 For The Competition, fifty (50) images will be selected as contenders for the shortlist by the judging panel formed by a minimum of two professionals within Canon and at least 1 (one) judge associated with a Canon agency (“Judging Panel”) in their sole discretion—judging will be based on the technique, creativity and original and interesting interpretation of the theme. The Judging Panel’s decision is final. The 50 images will be shared with Canon Ambassador Gali Tibbon (“The Ambassador”), who will choose a final 8 (eight) shortlist at her sole discretion—judging will be based on the technique, creativity and original and interesting interpretation of the theme.
The selection steps of The Competition are:
(1) The Judging Panel will select fifty (50) images within 24 hours after the Close Date of Uploading Period;
(2) Canon will contact entrants who uploaded the fifty images and ask them to send via a provided email address the original images with the EXIF data retained and verify their entries comply with these Terms. Entrants will have 48 hours to respond in order to qualify.
(3) From the short list of fifty images, only eight (8) shortlist images will be chosen by The Ambassador.
2.2 The entrants who uploaded the shortlisted images will become the shortlist winners (“Shortlist Winners”). Each Shortlist Winner image will be edited to add the first name of the Shortlist Winner in text overlayed at the bottom right of the image. The Shortlist Winners will be announced in 2 (two) batches chosen at random – the Shortlist Winners will be announced on the dates as below (“Shortlist Announcement Date”) via Facebook and Twitter and each Shortlist Winner will be notified by private message on Facebook or direct reply and/or direct message on Twitter (depending on where the user submitted the image):
(1) Shortlist batch 1: 20/09/16
(2) Shortlist batch 2: 21/09/16
2.3 On each Shortlist Announcement Date Canon will post all four images on Facebook and Twitter in one post, and a consumer competition will be opened to the public (“The Public”) between 10:00 CEST and 17:00 CEST (“The Open Times”). The Public will be asked to vote during The Open Times for their favourite by commenting with the name of their favourite image on the Facebook post, or replying to the Twitter post with the name of their favourite. One (1) finalist (“Shortlist Winner Finalist”) will be determined from each batch based on the highest number of votes, which will be counted by a minimum of one professional within Canon.
2.4 On 22/09/16 Canon will post the two Shortlist Winner Finalist images on Facebook and Twitter, and a consumer competition will be opened to the public (“The Public”) between 10:00 CEST and 17:00 CEST (“The Open Times”). The Public will be asked to vote during The Open Times for their final winner by commenting with the name of their favourite image on the Facebook post, or replying to the Twitter post with the name of their favourite. One (1) Shortlist Winner Finalist will be determined as the winner (“Grand Prize Winner”) based on the highest number of votes, which will be counted by a minimum of one professional within Canon. The Grand Prize Winner will be announced on Twitter and Facebook at 10:00 CES on 23/09/16.
3.1 The seven (7) Shortlist Winners not named as the Grand Prize Winner will each be awarded with a Canon PowerShot G7 X Mark II as the prize, the one (1) Grand Prize Winner will be awarded a Canon EOS 5D Mark IV, a trip for two people to Granada and a photography masterclass from The Ambassador while in Granada (collectively, “Prize”).
3.2 The Grand Prize Winner trip to Granada will take place between 01/10/2016 and 20/12/2016 – with a precise date to be agreed between Canon, The Ambassador and The Grand Prize Winner. The Grand Prize Winner will take one place, and will be permitted to bring one guest. The photography masterclass will be hosted by The Ambassador and take place for one day in Granada, lasting between 09:00 and 17:00. The trip includes two economy class flights (“The Flights”), one room in a minimum three-star hotel in Granada (“The Hotel”), and airport transfers via a car service between Granada Airport and the hotel.
3.3 Canon will endeavour to deliver the Prize to each Shortlist Winner, the Canon EOS 5D Mark IV to the Grand Prize Winner and agree the Granada trip date with the Grand Prize Winner within 30 days after the announcement of Grand Prize Winner. Any Prize returned to sender or undelivered due to inaccurate details provided by You will be deemed unwanted and the Prize will be lost.
3.4 Winners must confirm acceptance of the Prize within 14 days of notification. If the Prize is not accepted within 14 days of notification, it will revert to Canon and may be relocated to another entrant at the absolute discretion of Canon.
3.5 There are no cash or other prize alternatives available in whole or in part. Canon reserves the right to provide an equivalent prize (of equal or higher specification and of equivalent or higher value) in the event that the Prize is not available.
3.6 Canon will cover any obligation with regard to any tax or other obligations related to the Prize.
4. COMPETITION REQUIREMENT
4.1 You must own or control all of the rights to the images uploaded for this Competition and have the absolute right to enter the images into this Competition having obtained the permission of any other person who may have any right or interest in the images uploaded.
4.2 The original file with EXIF data must be provided for submitted photos when as requested by Canon.
4.3 You must not upload images contain:
(1) Recognisable persons, unless You can demonstrate that such persons have granted all the necessary permissions for his/her image to be used and published by Canon under these Terms; or
(2) Works of art, unless You can demonstrate that You have been granted a licence to have such works of art used and published by Canon under these Terms;
(3) Logos and brand names, unless You can demonstrate that You have been granted a licence to have such logo or brand names used and published by Canon under these Terms;
(4) Anything illegal or anything that may infringe rights of Canon or any third party;
(5) Anything discredits or denigrates anyone’s image, personal reputation or commercial reputation; or
(6) Anything which may be considered obscene, immoral or in any way inappropriate or unpleasant including nudity and violence etc.
4.4 You may undertake digital manipulation in order to optimise an image, but adding or removing key elements or the image is not allowed. Composite or montage images, from more than one original image, are not eligible for entry into the Competition.
4.5 You must pay for all royalties, fees and any other monies that are owed to any person by reason of any image uploaded by You in connection with the Competition.
4.6 By posting your images on Canon Photokina Facebook Page and/or Twitter and entering into this Competition, you hereby grant to Canon and its affiliates, their sub-licensees and agents, a EMEA-wide royalty-free assignable non-exclusive licence (“Licence”) to use, reproduce, and publish (whether in their entirety or in cropped or edited mode) Your uploaded image(s) for the purpose of operating and promoting this Competition or Photokina whether printed or on the internet (including without limitation on any Canon Facebook Pages or Twitter Pages):
I. on Canon’s, Canon affiliates’ and third parties’ websites or on social media without limit in time; and
II. at the Photokina 2016 exhibition.
You hereby warrant that You have all necessary rights and authority to enter into this agreement and grant such licence to Canon, its affiliates, sub-licensees and agents
4.7 You also agree to be contacted by Canon for the purposes of administrating the Competition or in the event that Canon wishes to discuss any other use of image submitted to the Competition.
4.8 Canon reserves the right to disqualify incomplete or illegible entries or which do otherwise not meet the above requirements.
4.9 You must comply with applicable terms and conditions and/or policies of Facebook and Twitter.
5.1 Canon will only use Your image and personal information supplied for the administration of the Competition including, but not limited to, contacting You and announcing the Winners etc. You hereby explicitly consent to Your personal information being transferred and proceed within European Union by Canon in association with this Competition.
5.2 For the purpose of this Competition, the data controllers of Your personal information are Canon Europa N.V. registered in Amsterdam under registration number 33166721 having a place of business at Bovenkerkerweg 59, 1185 XB Amstelveen, The Netherlands; and Canon Europe Limited registered in United Kingdom under a registration number 4093977 having a place of business at 3 The Square, Stockley Park, Uxbridge UB11 1ET, United Kingdom.
6.1 Canon shall not be liable for any failure to meet these Terms of Competition where such failure is caused by any supervening circumstances amounting to force majeure. Such circumstances shall include, but shall not be limited to severe weather conditions, fire, flood, war, earthquake, riots, industrial dispute, terrorism, acts of god, or events that, without fault of either party, render performance impossible or incapable of satisfactory execution.
6.2 By entering into the Competition, You agree to release and hold Canon harmless from and against any claim or cause of action arising out of participation in the Competition or receipt or use of any Prize.
7.1 Owing to exceptional circumstances outside its reasonable control and only where circumstances make this unavoidable, Canon reserves the right to cancel or amend the Competition or these Terms at any stage but will always endeavour to minimise the effect to You in order to avoid undue disappointment.
7.2 The Laws of England and Wales will apply to this Competition and the parties agree to exclusive jurisdiction of the courts of England and Wales.
